Terms of use

These terms are the agreement between you and Hushpiper Ltd (company number to follow, registered address to follow), which runs Hushpiper ("we", "us"). By creating an account or using Hushpiper you agree to them. Please also read our privacy policy and community guidelines, which form part of these terms.

1. Who can use Hushpiper

You must be at least 13 years old, and give your real year of birth when you sign up. People under 18 get extra protection: people they don't know can't find, message or add them.
You must be allowed to use a service like ours where you live, and not have been banned from Hushpiper before.
If you use Hushpiper for an organisation, you confirm you're allowed to accept these terms for it.

2. Your account

Pick a username that doesn't pretend to be someone else, and keep your password and your 12-word recovery phrase safe. We can't recover your account without the recovery phrase or one of your signed-in devices, and we can't restore messages we never had.
You're responsible for what happens on your account. Tell us at support@hushpiper.com if you think someone else is using it.
You can have up to 10 signed-in devices, and you can sign any of them out at any time.

3. What we provide

Hushpiper lets you send end-to-end encrypted messages, calls and files, join and run channels, and use optional features such as the AI assistant, panic recording and check-ins.
Hushpiper is free. We may add paid extras in future; we'll never make features you already use paid without telling you well in advance.
We work hard to keep Hushpiper running, but it's provided "as is": it may sometimes be unavailable, and features may change. Messages waiting for delivery are kept for a limited time (see the privacy policy), so a device that stays offline for a long time may miss some.
Hushpiper is not an emergency service. The panic button and check-ins can alert people you've chosen, but they may not work if your phone has no signal, no battery or has been taken. Always contact the emergency services directly when someone is in danger.
The AI assistant can be wrong. Don't rely on it for medical, legal, financial or safety decisions.

4. Your content

What you send belongs to you (or whoever owns it). You give us only the permission we need to store and deliver it: because it's encrypted, we can't read most of it anyway.
Public channel posts are public. By posting in one, you let us show the post to anyone who opens the channel, until it's deleted.
You're responsible for what you send and post, and you must have the right to share it.

5. Using Hushpiper responsibly

You must follow our community guidelines. In short, don't use Hushpiper to break the law, harm or exploit anyone (especially children), harass people, spam, spread malware, or attack or overload our service. Don't try to get around a block, a ban or a chat's privacy settings.

6. Reports, moderation and bans

You can report a person, a chat or a channel from the app. Reports include the messages you choose to send us, so we can review them.
We can't see encrypted messages unless someone reports them to us. We do review reports, public channels and the account information we hold.
If you break these terms, we may remove content we can see, hide a channel, limit features, or suspend or ban an account, depending on how serious it is. Where the law requires, we report illegal content, such as child sexual abuse material, to the authorities.
If we act against your account, we'll tell you why in the app where we can, and you can appeal from the app. A person will review your appeal.

7. Ending your account

You can delete your account at any time in the app (Settings, tap your name, Delete my account).
Accounts nobody uses for 4 months (no signed-in device opens Hushpiper) are deleted, after a warning in the app 14 days before. Using any of your devices cancels it. Accounts with panic recordings or trusted contacts are kept.
We may close accounts that break these terms.

8. Our liability

Nothing in these terms limits liability that can't be limited by law, including for death or personal injury caused by our negligence, or for fraud, and nothing affects your legal rights as a consumer.
Otherwise, we aren't responsible for losses that weren't reasonably foreseeable, for what other users send or do, or for losses caused by events outside our reasonable control. Because Hushpiper is free, if you use it for business, we aren't liable for loss of profit, business or data.

9. Changes to these terms

If we change these terms in a way that matters, we'll tell you in the app at least 30 days before (unless the change is needed sooner for legal or safety reasons). If you don't agree, you can delete your account before the change takes effect.

10. The law that applies

These terms are governed by the law of England and Wales. You can bring a claim in the courts of England and Wales, or in the courts where you live if you're a consumer in Scotland or Northern Ireland.
